Special Tips

This Agreement provides for the rights and obligations of both the Intelligent Transportation Innovative Technology Application Competition in the Yangtze River Delta (hereinafter referred to as the ITITAC) and users concerning the software service (hereinafter referred to as the "Service") for the competition event. "Users" refer to individuals who download, install, register, log in and use (hereinafter collectively referred to as "use") this Service. The ITITAC hereby specially reminds you (the user) to carefully read this User Agreement (hereinafter referred to as the "Agreement") before registering as a user to ensure that you fully understand the articles hereof. Please carefully read and fully understand this Agreement, especially the articles concerning exemption or limitation of liability, rights permission and information use, consent to open and use a special single service, law application and dispute resolution. Among them, the articles related to exemption or limitation of liability and other important contents shall be highlighted in bold to call users’ attention. You should be fully aware of them. If you do not agree to this Agreement, the ITITAC will not be unable to provide you with complete products and services, and you can also choose to stop using the Service. If you voluntarily choose to agree or use the software and related services of the ITITAC, it is deemed that you have fully understood this Agreement, and agree to be bound by this Agreement and other agreements and rules related to the software and related services of the ITITAC (including but not limited to the Privacy Policy of the ITITAC) as a party to this Agreement.

To provide users with better services or to adapt to changes in the national laws and regulations, policy adjustments, technical conditions, product functions, etc., this Agreement can be revised and updated in due time by the ITITAC, and the revised content constitutes an integral part of this Agreement. After the update of this Agreement, the ITITAC will remind users of the updated content through announcements on its official website or other appropriate ways, so that users can know the latest version of this Agreement in time. Users can also check the articles of the latest version of this Agreement on the home page of our website or the software settings page. If the user continues to use the software and related services of the “ITITAC”, it means that the user has agreed to accept the revised contents of this Agreement.

I. Account Registration

1. Before using this Service, the user needs to register an account for the “ITITAC”. The competition account shall be registered by binding a mobile phone number. The user shall use a mobile phone number that hasn’t been bound with an account number for the ITITAC and register an account number for the ITITAC with a mobile phone number that hasn’t been banned by the ITITAC according to this Agreement. The ITITAC can change the way of account registration and binding according to user needs or product needs.

2. In view of the binding registration method for the account of the “ITITAC”, the user agrees that the ITITAC will use the mobile phone number provided by the user and/or automatically extract the user’s mobile phone number and other information for registration in the process of registration. The user agrees to give the operator authorization, and the authorized operator has the right to automatically extract the user’s mobile phone number for authentication and use it for account registration for the “ITITAC”. The user promises to comply with the relevant service terms of the operator. If the operator successfully authenticates the user’s mobile phone number, the user’s registration is completed. If the user does not agree to authorize the operator and/or the operator’s service terms or the authentication of the user’s mobile phone number fails, the user can manually modify the mobile phone number extracted by the operator and register and log in with the verification code.

3. The user understands and undertakes that the account set by the user shall not violate the national laws and regulations and the relevant rules of the ITITAC, and the user’s account name, avatar, profile and other registration information and other personal information shall not contain illegal or harmful information. The user shall not open an account in the name of others (including but not limited to using others’ names, styled names, nicknames, avatar, etc. or using other methods that might cause confusion) without their permission, and the user shall not maliciously register accounts for the ITITAC (including but not limited to frequent registration, batch registration of accounts, etc.). Users shall abide by relevant laws and regulations in the process of account registration and use, and shall not commit any act that undermines the national interests, infringes on the legitimate rights and interests of other citizens, or does harm to social morality. The ITITAC has the right to audit the registration information submitted by the user.

4. When users register and use this Service, the ITITAC needs to collect personal information that can identify users, so that it can contact users when necessary, or provide them with a better use experience. The information collected in the ITITAC includes but is not limited to the user’s name, gender, age, date of birth, ID card number, address, information of school, company and industry, and personal description. The use of such information by the ITITAC will be subject to Article 3 Protection of Users' Personal Privacy Information.

II. Service Contents

1. The specific content of this Service is provided by the ITITAC according to the actual situation, including but not limited to authorizing users to sign up for the competition, submit works and other operations through their accounts.

2. The ITITAC grants the user a personal, revocable, non-transferable, non-exclusive and non-commercial right to legitimately use the software and related services of the ITITAC.

III. User Personal Information Protection

1. In the process of registering an account or using this Service, the user may need to fill in or submit some necessary personal information, such as the identity information required to be filled in by laws and regulations, rules and normative documents (hereinafter referred to as “laws and regulations”). If the information submitted by the user is incomplete or does not comply with the provisions of laws and regulations, the user may not be able to use this Service or may be restricted in the process of using this Service.

2. The user’s personal information includes: 1) The user’s personal information provided by the user at his own discretion (such as the mobile phone number and other personal information filled in by the user during registration). 2) The ITITAC legitimately collects the user’s personal information (such as equipment or software information automatically collected by the system when the user uses the service, historical browsing information, time information and other information) to provide services. Personal information refers to all kinds of information recorded electronically or in other ways that can identify a specific natural person or reflect the activities of such person independently or together with other information. The user knows, understands and agrees that when using the products and/or services of the ITITAC, the ITITAC will process and protect the user’s personal information in accordance with the Privacy Policy of the ITITAC published by the platform. Therefore, the user is expected to carefully read and fully understand the full text of the Privacy Policy, and make appropriate choices as needed according to the guidance of the Privacy Policy.

3. The ITITAC attaches importance to the protection of personal information. The ITITAC will take technical measures and other necessary measures to ensure the safety of users’ personal information and prevent the leakage, damage or loss of the personal information collected in this Service. In case of the above situations or the ITITAC finds the possibility of the occurrence of the above situations, it shall take remedial measures in a timely manner and inform the user. If the user finds the above situations, he shall also immediately communicate with the ITITAC.

4. The ITITAC shall not disclose the user’s personal information to any third party without the user’s consent. But the following special circumstances are exceptional:

(1) Personal information provided by the ITITAC according to laws and regulations or the instructions of competent authorities;

(2) Any personal information leakage caused by the user’s disclosure of their user passwords to others or sharing his registered account and password with others, or other personal information leakages which are caused by reasons other than those of ITITAC;

(3) Personal information that the user discloses to a third party by himself;

(4) Personal information made public by the ITITAC to the partner as a result of the agreement reached between the user, ITITAC, and its partner on the use and disclosure of the user’s personal information;

(5) Any leakage of the user’s personal information due to hacker attacks, computer virus intrusion and other force majeure events;

(6) The user’s personal information which has been processed, is identifiable and can’t be restored.

5. The user agrees that the ITITAC can use the user’s personal information in the following matters:

(1) Important notices issued by the ITITAC to users in a timely manner, such as software updates and changes to the articles of this Agreement;

(2) The internal audit, data analysis and research conducted by the ITITAC to improve the products and services of the ITITAC and its communication with users;

(3) Management and review of user information by the ITITAC and handling measures taken by the ITITAC according to this Agreement;

(4) Other matters stipulated by applicable laws and regulations.

In addition to the above matters, the ITITAC shall not use the user’s personal information for any other purpose without the user’s prior consent.

6. The ITITAC attaches importance to the protection of minors. The ITITAC shall rely on the personal information provided by users to determine whether users are minors. Any minors under the age of 18 are not allowed to register an account on the ITITAC website or use this Service.

7. The ITITAC guarantees that the user’s personal information shall be collected, used or disclosed in line with the principles of legality, legitimacy and necessity and that it may not collect the user’s personal information unrelated to the services provided.

8. The ITITAC lays great stress on protecting users’ personal information and privacy and has formulated the Privacy Policy of the ITITAC. Users should carefully read and fully understand the Privacy Policy of the ITITAC, and then use the products and/or services of the ITITAC. If users do not agree with the contents of the policy, the products and/or services of the ITITAC might function normally, or the service effect supposed by the ITITAC may not be reached. Therefore, it is recommended that users thoroughly read the Privacy Policy of the ITITAC to help themselves better protect their right of privacy.

IV. Content Specification

1. The content mentioned in this article refers to any content created, uploaded, copied, published and disseminated by the user in the process of using this Service, including but not limited to the registration information and authentication materials such as account avatar, name, user description, or messages sent, replied or automatically replied, including text, voice, picture, video, image-text, as well as related link pages, and other content generated by using the account or this Service.

2. The user shall not use the account of the “ITITAC” or this Service to create, upload, copy, publish or disseminate the following content prohibited by laws, regulations and policies:

(1) Opposing the cardinal principles specified in the Constitution;

(2) Jeopardizing national security, disclosing state secrets, subverting the national political power and undermining national unity;

(3) Damaging the national reputation and interest;

(4) Distorting, defaming, blaspheming or negating the deeds and spirits of heroes and martyrs, or infringing upon the names, portraits, reputation or honor of heroes and martyrs by insulting, slandering or other means;

(5) Preaching terrorism and extremism or inciting terrorist or extremist activities;

(6) Inciting ethnic hatred and racial discrimination and undermining the national unity;

(7) Damaging national religious policy, propagating heresy and feudal superstition;

(8) Spreading rumors and disrupting economic and social order;

(9) Spreading obscenity, pornography, gambling, violence, murder, terrorism or abetting the crime;

(10) Insulting or slandering others, or infringing upon others’ reputation, privacy or other legitimate rights and interests;

(11) inciting illegal assembly, association, procession, demonstration or gathering to disturb public order;

(12) carrying out activities in the name of an illegal non-governmental organization;

(13) Failure to abide by "seven baselines": a baseline for laws and regulations, socialist system, national interest, citizens’ legitimate rights and interests, social public order, morality, and information authenticity, respectively;

(14) Containing the information which is prohibited by laws, administrative regulations or policies.

V. Use Rules

1. Any content transmitted or released by the user in or through this Service does not reflect or represent, nor is it deemed to reflect or represent the views, positions or policies of the ITITAC, and the ITITAC does not undertake any responsibility for this.

2. Users shall not use the account of “ITITAC” or this Service for the following acts:

(1) Submitting and releasing false information, or stealing others’ avatars or materials, pretending to be someone else and acting in the name of others;

(2) Coercing, inducing other users to pay close attention to, click link page, or share information;

(3) Maliciously falsifying facts and concealing the truth to mislead and deceive others;

(4) Establishing false account numbers in batches with technological means;

(5) Engaging in any illegal or criminal activities by using the ITITAC account or this Service;

(6) Making and publishing the methods and tools related to the above acts or operating or disseminating them, regardless of the commercial purpose of such acts;

(7) Other acts that violate laws and regulations, infringe on the legitimate rights and interests of other users, interfere with the normal operation of the ITITAC or the acts which are not explicitly authorized by the ITITAC.

VI. Statement of Intellectual Property Rights

1. The copyright or trademark rights of the image, text or their combinations involved in this Service of the ITITAC, as well as other logos, products and service names of the ITITAC (hereinafter collectively referred to as the “ITITAC logos”) belong to the ITITAC. Without the prior written consent of the ITITAC, users shall not display, use or otherwise dispose of the logo of the ITITAC in any means, nor indicate to others that they have the right to display, use or otherwise dispose of the logo of the ITITAC.

2. The above and any other intellectual property rights legally owned by the ITITAC or relevant advertisers are protected by law. Without the written consent of the ITITAC or relevant advertisers, users shall not use them in any form or create related derivative works with them.

VII. Legal Liability

1. If the ITITAC finds or receives whistle-blowing or complaints from others that a user violates this Agreement, the ITITAC has the right to review and delete relevant content, including but not limited to user data and chat records, at any time without prior notice, and punish the offending account, including but not limited to warning, refusal to publish, deletion of content, restricting part or all functions of the account until termination of services and permanently closing the account and other measures. The ITITAC does not bear any liability for the consequences arising therefrom, such as the user’s failure to normally use the account and relevant services, and obtain assets or other rights and interests in the user’s account. The ITITAC will notify the user of the handling results, and it has the right not to restore the content it has deleted.

VIII. Force Majeure and Other Exemptions

1. Users understand and confirm that there might be force majeure and other risk factors which can disrupt this Service in the process of using this Service. The force majeure mentioned in this Agreement means objective events that are unforeseeable, insuperable and inevitable and have a significant impact on a party or both parties, including but not limited to natural disasters such as floods, earthquakes, plagues, epidemics and storms as well as social incidents such as war, turmoil and government behavior. In the case of the above situations, the ITITAC will try to cooperate with relevant units immediately for timely repair. However, the ITITAC and its partners will be exempted from liability for the losses incurred therefrom to the user or a third party within the scope permitted by the law.

2. Like most Internet services, this Service is subject to the impact of differences including but not limited to user reasons, network service quality, social environment, and other factors, and may be beset by various security issues, such as annoyances in real life caused by others using the user information; Viruses such as "Trojan horses" contained in other software that the user downloads or in other websites that the user visits, which threaten the security of the user’s computer information and data, and further affect the normal use of this Service. The user should strengthen protection awareness of information security and user data, and pay attention to strengthening password protection, to avoid losses and disturbances.

3. The user understands and confirms that there is a risk of service interruption or failure to meet the user’s requirements due to force majeure, computer virus or hacker attacks, system instability, user location, user shutdown and any other technology, Internet and communication lines, and other reasons. The ITITAC shall not bear any liabilities for any losses caused to the user or a third party.

IX. Miscellaneous

1. The ITITAC solemnly reminds users to pay attention to the articles in this Agreement that exempt the liabilities of the ITITAC and that restrict users’ rights. Users are requested to read them carefully and take risks into account independently.

2. The laws of the People’s Republic of China are applicable to the force, interpretation of this Agreement and the dispute resolution arising therefrom. Any dispute or controversy between the user and the ITITAC shall be settled through friendly consultation first. If the consultation fails, the user agrees to submit the dispute or controversy to the people’s court with jurisdiction in the place where the ITITAC is located.

3. Whether any article herein is invalid or inexecutable due to any reason, the remaining articles are still valid and are binding on both parties.
